Food is one of the most regulated product groups entering the US. Most problems can be avoided with four pieces of preparation.
1. FDA food facility registration
Facilities that manufacture, process, pack or hold food for US consumption must register with FDA and renew every two years during the renewal window (October–December of even-numbered years — so the end of 2026 is a renewal period). Foreign facilities must name a US agent.
2. Prior Notice
FDA must receive Prior Notice before food arrives — the deadline depends on the mode (shorter for air than for sea). Shipments without valid Prior Notice can be refused or held.
3. FSVP — the importer's responsibility
Under the Foreign Supplier Verification Program, the US importer must verify that foreign suppliers meet US safety standards. Under DDP the seller side may be expected to support or even hold this responsibility — clarify it before quoting.
4. Labelling
- English labels with product name, net quantity, ingredients, allergens, nutrition facts (where required) and the name/address of manufacturer or distributor.
- Country of origin marking.
Common reasons for FDA holds
- Missing or wrong facility registration or Prior Notice.
- Undeclared allergens or incorrect labels.
- Products subject to an FDA import alert.
